Fan–Creator Terms

1. What These Terms Are
1.1 These Fan–Creator Terms govern each transaction between a Fan and a Creator on Belnoir: buying an item, subscribing, sending a tip, paying to unlock a message, ordering a physical item, or paying for a custom request (each, a “Creator Transaction”). Each Creator Transaction is a contract between that Fan and that Creator on these terms.
1.2 Belvista Digital Solutions LLC (“Belnoir”) operates the Platform and collects payments as the Creator’s limited payment collection agent (Section 8.2 of the Terms of Service), but Belnoir is not a party to Creator Transactions. These terms do not change the Terms of Service, Acceptable Use Policy, Privacy Policy or Creator Agreement, which continue to apply to each of you. If these terms conflict with the Terms of Service, the Terms of Service control.
1.3 Capitalized words not defined here have the meanings in the Terms of Service.
2. What the Fan Gets
2.1 A personal licence. When a Fan pays for Content, the Creator grants the Fan a limited, personal, non-exclusive, non-transferable, non-sublicensable licence to view that Content on Belnoir (and, where Belnoir offers a download, to keep a copy on the Fan’s own device) for the Fan’s private, non-commercial use only. For subscriptions, the licence covers the Creator’s subscriber Content for as long as the subscription is active.
2.2 What the licence doesn’t allow. The Fan may not:
- share, post, upload, send, sell, rent or otherwise make any Content available to anyone else, anywhere, including other websites, forums, chats or file-sharing services;
- screen-record, capture, copy or archive Content, except a download Belnoir provides for the Fan’s own private use;
- edit, alter, combine or create new works from Content, or use it, or anyone’s likeness from it, to train or prompt artificial intelligence tools;
- share their account or let anyone else view Content through it; or
- use Content to identify, contact, locate or harass the Creator or anyone in it.
2.3 Ownership. The Creator (or the Creator’s licensors) keeps all rights in the Content. Buying access to Content, or paying for a custom request, does not transfer ownership or copyright to the Fan.
2.4 When access ends. The licence ends automatically if the Fan breaks these terms, if the purchase is refunded or charged back, if a subscription ends, or if the Fan’s account is closed or terminated. Content may also become unavailable if it is removed by the Creator or by Belnoir (for example for legal, safety or consent reasons). Refunds are handled under Section 6 of the Terms of Service.
2.5 Watermarks and leaks. Content may carry watermarks that identify the Fan’s account. The Fan must not remove, obscure or bypass them. If the Fan breaks Section 2.2, the Fan is liable to the Creator (and to every Performer in the Content) for all resulting loss, including lost revenue and reasonable attorneys’ fees and costs, to the extent permitted by law, and may also be liable for copyright infringement.
3. The Creator’s Promises
3.1 For every Creator Transaction, the Creator promises the Fan that:
- the Creator has every right needed to offer the Content and grant the licence above;
- everyone who appears in the Content is an adult who has been verified by Belnoir and has given signed consent to being recorded and to the Content being sold on Belnoir;
- the Content, item or service will match its description and price, and custom requests will be delivered by the due date shown when accepted; and
- the Creator will treat the Fan’s personal information confidentially and only as the Creator Agreement allows.
3.2 Except where the Creator has said otherwise in the item’s description, a subscription doesn’t promise any particular amount or frequency of new Content.
3.3 Except for the promises in Section 3.1, Content is provided “as is.” Previews, descriptions and thumbnails are representative and may differ from the full Content. To the extent permitted by law, a Creator’s total liability to a Fan for any Creator Transaction is limited to the amount the Fan paid for it.
3.4 Creators may have help running their accounts, and must not claim messages are personally written by them when they are not. Paying, subscribing, tipping or messaging does not create a personal, romantic or exclusive relationship, and Creators never offer in-person meetings or services.
4. The Fan’s Promises
4.1 For every Creator Transaction, the Fan promises the Creator that the Fan:
- is at least 18 years old (and the age of majority where they live), has passed Belnoir’s age verification, and is allowed by local law to view the Content;
- will pay the price shown, and won’t charge back a payment they authorized;
- will follow the licence limits in Section 2;
- won’t ask for or pay for anything the Acceptable Use Policy prohibits, or for meetings, contact details or payment outside Belnoir; and
- will treat the Creator with respect, and won’t harass, threaten or pressure them; and
- won’t try to identify, locate or contact the Creator or any Performer outside Belnoir.
5. Prices, Payments, Tips and Subscriptions
5.1 Creators set their own prices within the limits Belnoir sets, in US dollars. The Fan pays Belnoir as the Creator’s agent, and the Fan’s payment obligation is met once Belnoir receives payment. Creators receive their share under the Creator Agreement.
5.2 Subscriptions renew automatically at the price shown until the Fan cancels. A Fan can cancel at any time from Settings and keeps access until the end of the period already paid for.
5.3 Tips are voluntary gifts to the Creator. A tip does not buy Content, a service or any promise from the Creator unless the Creator has offered something in exchange on Belnoir, in which case it is a purchase covered by these terms.
6. Custom Requests
6.1 A Creator may accept or decline any custom request. A request may only ask for Content the Acceptable Use Policy allows; Belnoir reviews custom Content before it is delivered, like all Content.
6.2 Once accepted and paid, the Creator will deliver by the due date shown. If it isn’t delivered on time, or is rejected in review, the Fan may be refunded under Section 6 of the Terms of Service. Delivered custom Content is licensed to the Fan under Section 2, and the Creator keeps ownership.
7. Physical Items
7.1 Physical items are sold and shipped by the Creator, not by Belnoir. The Fan pays the shipping cost shown at checkout. Items are shipped from, and returned to, the Creator; nothing is sent to Belnoir.
7.2 The Creator will describe items accurately and ship them promptly with the tracking provided. If an item doesn’t arrive or isn’t as described, the Fan should first contact the Creator through Belnoir messages; if it isn’t resolved, contact [email protected]. Refunds are handled under Section 6 of the Terms of Service.
8. Disputes Between Fans and Creators
8.1 Fans and Creators should try to resolve problems with each other first, respectfully and through Belnoir. Either may also contact [email protected], and Belnoir may help, decide refunds under its Terms of Service, or take action under the Acceptable Use Policy, but is not obliged to resolve disputes between Fans and Creators.
8.2 Claims against Belnoir itself are governed by the Terms of Service, including its dispute resolution and arbitration provisions.
8.3 These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any claim between a Fan and a Creator must be brought individually in a small claims court of competent jurisdiction or in the state or federal courts located in St. Louis County, Missouri, except where Applicable Law gives the Fan a non-waivable right to bring it where the Fan lives.
8.4 Belnoir’s right to enforce. Belnoir is an intended third-party beneficiary of these terms. Belnoir may enforce them, including Sections 2 and 4, on its own behalf and, where the Creator agrees, on the Creator’s behalf.
9. General
If any part of these terms is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect. A failure to enforce any part is not a waiver. These terms, together with the documents named in Section 1.2, are the entire agreement between a Fan and a Creator about a Creator Transaction.
10. Changes
Belnoir may update these terms from time to time on the Creator’s and Fan’s behalf. The version in effect when a Creator Transaction is made applies to it, and changes apply to new Creator Transactions (including subscription renewals) from the date they take effect.
